Physical Activity Waiver & Release of Liability

This Physical Activity Waiver & Release of Liability (the “Waiver”) is a legally binding agreement between you (“you”, “client”, or “participant”) and The Hot Room SRL (“THR”, “we”, “us”, or “our”).

By booking, attending, or participating in any yoga class, workshop, event, or other activity (collectively, the “Activities”) at our studio, you acknowledge that you have read, understood, and voluntarily agree to be bound by the terms of this Waiver. This Waiver is a supplement to our Terms of Service and Privacy Policy.

If you do not agree to these terms, you are prohibited from participating in any Activities.

Your health and well-being are a top priority. To create a safe environment for everyone, we both have a role to play.

Our Commitment:

• We commit to providing a clean and safe facility.
• Our instructors are there to offer guidance and modifications to support your practice.
• We offer "Hot", "Warm" and other classes to accommodate different preferences and sensitivities.

What are my responsibilities as a participant? You are responsible for your own health and safety. By participating in our Activities, you affirm that:

• You have consulted with a physician or other qualified healthcare provider regarding your participation, especially if you have pre-existing health conditions.
• You are in good physical health and have no medical condition that would prevent your safe participation.
• You will immediately stop any activity that causes you pain or discomfort and inform the instructor.
• You will keep us informed of any limitations. While you are not required to disclose specific medical conditions, you are obligated to inform us of any restrictions you have (e.g., “I need to avoid temperatures above 30°C” or “I cannot attend Hot classes”). We will rely on your honest self-reporting and treat any notification with due consideration.

I understand that participating in yoga and other physical activities carries inherent risks. I acknowledge that:

• All physical exercise, including yoga, can be strenuous and may lead to injury, including but not limited to muscle strains, sprains, joint injuries, and falls.
• Studio facilities, including changing rooms and showers, may have wet floors. I will move carefully to avoid slips and falls.
• I voluntarily and knowingly assume all risks associated with participating in the Activities, even if such risks are caused by the actions, inaction, or negligence of the studio or its staff.

We want you to be fully informed about the specific environment of our heated classes.

• Hot Yoga: These classes are conducted in a room heated up to, and sometimes exceeding, 40°C. This environment is designed to be challenging and can place significant demand on the body.
• Warm Yoga: These classes are typically in the 20s°C but may reach into the 30s°C.

Engaging in physical activity in a heated environment can increase the risk of dehydration, heat exhaustion, heat stroke, and may exacerbate certain medical conditions.

By choosing to participate in a heated class, you affirm the following:

1. You are fully aware of the risks associated with exercise in a high-temperature environment.
2. You will not attend Hot classes if you have any concerns about your ability to safely practice in the heat.
3. You will seek medical advice if you are in any doubt about your suitability for heated yoga.
4. You will inform us of any pre-existing conditions that may be affected by heat, including but not limited to heart conditions, high/low blood pressure, respiratory issues, or pregnancy.

In consideration for being permitted to participate in the Activities, I, on behalf of myself, my heirs, assigns, guardians, and legal representatives, hereby fully release, waive, discharge, and agree not to sue The Hot Room SRL, its directors, officers, instructors, employees, agents, and representatives (the “Released Parties”) from any and all liabilities, claims, demands, actions, or causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, in connection with my participation in the Activities.

This release applies to any and all claims, whether foreseen or unforeseen, including those arising from the alleged carelessness, negligence, or gross negligence of any Released Party or any other participant. I agree to indemnify and hold harmless each Released Party from any loss, liability, damage, or costs, including reasonable legal fees, they may incur as a result of any claim made by me or on my behalf.

• Physical Adjustments: Our instructors primarily use verbal cues. On occasion, an instructor may offer a light physical adjustment to help demonstrate proper form. If you wish to avoid any physical contact, you must inform your instructor at the beginning of class.
• Personal Property: We are not responsible for any lost, stolen, or damaged personal property. Please secure your belongings.
• Photography & Media: We reserve the right to photograph or film during our Activities and to use these images for our website, social media, and other marketing purposes. By participating, you consent to being included. If you do not wish to be photographed or filmed, it is your responsibility to explicitly notify us in writing.
• Minors: Individuals under the age of 18 are generally prohibited from participating in Activities. Exceptions may be considered on a case-by-case basis and require the express, written agreement to these terms by a parent or legal guardian in person at the studio.

I have carefully read this Waiver and fully understand its contents. I am aware that by agreeing to this document, I am waiving certain legal rights that I or my heirs may have against the Released Parties. I sign this agreement voluntarily and of my own free will.
